I recently posted the following in a web forum which was questioning whether the picture "Klara and Edda Belly Dancing" was art or not. What follows is my view. I'm reposting it because I would like to see whether any of the readers out there feel any differently. Feel free to leave comments.
There are quite a few ways of looking at this, not all of them palatable to everyone, but all of them having some merit. To figure it out though, we need to ask ourselves a few questions, which can be surprisingly basic while still holding some sophisticated answers.
Lets get the obvious one out of the way first. Is it child porn?
At the very top of wikipedia's definition of child pornography is this paragraph:

Child pornography refers to pornographic material depicting children. It is widely regarded as a form of child sexual abuse and as such these images and videos are illegal in most countries. While some legal jurisdictions outlaw only production of child pornography, others also prohibit distributing, possessing, and accessing child pornography. Prohibition generally covers visual representations of sexual activity by children under a given age but may also include all images of nude children, unless an artistic or medical justification can be provided.
That ticks some of the boxes, but as you can see from the quote, there are quite a few get out clauses there.
We don't have to worry about the medical justification, so that's gone. Does this picture show children being sexually abused? Not really, it simply seems to be two children playing a game before bathtime.
It should probably be added however that most people's perceptions of pornography probably includes the proviso that the image was produced with the intention of arousing the viewer in a sexual manner. This is important, as one art critic notices when he saw it. More on that in a bit.
It is an image of a nude child though, so it could be, unless we apply another test. Is it art?
That of course is a heavily subjective question, so we will go back to that most democratic institution and find that

The same article however supplies the reasoning that

So we come up with the answer that going by reasonable definitions of the terms, this picture probably isn't child pornography.
But it may be art. To answer that question, you have to refer to the definitions above.

It isn't a fabulous picture, lets be honest. It looks like it was taken in a darkened room with a bright flash on a cheap camera. So in that sense, no, I wouldn't say it fits the criterion. On the other hand though, what could be more innocent and beautiful than a joyous child, whatever the state of dress?
Perhaps thats why the picture was taken in the first place, by a parent who was caught up in the fun that the two girls looked like they were having at that moment.
The fact that it was fun though, doesn't make it art and to be honest, there are thousands of poses which could show of the beauty which is a child better than the ones this photo depicts.
However, it does make you think, so in that way, you could well call it art.
I referred to an art critic who found himself challenged by the picture, which makes me think that perhaps - with a stretch - this picture could be called anti-pornography, in that it challenges the viewer to examine his or her motives when they view it. Thats pretty artistic really.
My view though, based on all of these arguments above and my gut feeling as well is this: This picture isn't child pornography. Given its context, it might be called art. To my mind though, I think it is simply inappropriate to put it on display. An innocent family shot perhaps. Not something for worldwide viewing.

After hearing of the police interest in this photo on the news the other night, I went online to have a look at the picture and I was somewhat at a loss to see why anyone would want such a photo let alone display it where anyone else could see it. I don't think it falls into the category of Pornography but I would question anyone's motives for taking such a picture. As a father of four , all grown up now I can remember many occasions where the kids would play while naked, before bath time for instance but to go and get the camera and record it, I think is rather strange. We have the usual snaps of the kids in the bath when they were small, but these we have been warned by the now grown up kids are to remain in our private collection and never to be shown to boyfriends or girlfriends. Why a parent would choose to allow a picture like this to be released to the public I do not know.
As an artist it drives me
As an artist it drives me crazy that child nudity is associated with paedophilia and criminalized. In classical art there are frequent depictions of nudes, both adults and children. Cupid and cherubs are good examples. These are not considered pornograhy. In face nudity was used as a symbol of innocence and purity (probably associated with Adam and Eve in the garden of Eden). Nudity DOES NOT equal pornography. On a practical basis it is now nigh impossible to study childrens anatomy, which is very different from adult anatomy, their proportions aren't the same. These also change depending on the age of the child. It is therefore very difficult for an artist to become proficient at drawing children.

Having not seen the photograph, i am probably not qualified or really able to give a subjective response to the matter. Saying that! I am a father of two young daughters and somewhat protective of them. Others may feel like me that we are often left feeling as though we are under scrutiny or feeling as though we may be preserved as child abusers if we show any form of affection to our children in public. But I do know that there are some who will get their “kicks” from viewing images of young children. It is these people that any form of child photography or “ART” should be censored or banned. A photograph of a baby (infant) taking a bath is a different thing but in the past has meant parents being wrongly considered abusers of their children.
Cherubs and angels were painted on cathedral walls and ceilings for centuries, all completely naked! These images are not considered pornography but “ART”. If a painting of one of my children was to be used as cherub displaying her genitalia, I would be furious. So were do we draw the line? I would say any image that shows REAL children, less than 18 years, naked should be considered inappropriate. But such a confusing situation and subject can cause real trauma and suffering to children and parents alike!
Art or pornography?
This picture was put on display in a gallery. Anyone visiting the exhibition would have known in advance the kind of artwork they were going to see.
The artist in question deals with controverisal issues, and produces controversial work.
Viewing these photos out of context, e.g. by googling them, is deceptive. If a parent stuck these photos on their wall at thome then yes of course that would be quite wierd. But these are in an art gallery: Context is everything.
The fact that the photos are a bit disturbing is the whole point of them. They are supposed (I think) to make us ask ourselves questions about perception of innocence. We are meant to be confused as to whether the photos are sinister or not. Why should a picture of two children happily and innocently playing make us feel uncomfortable?
Personally I think this is good art: It makes me think about a complex issue, raises some tough questions, and is also (I think) particularly relevant today when children are sexualised by fashion at an increasingly young age. The only reason this has become mainstream news is because the News Of The World wanted a bit of a scare story for their idiot readership.
Silly
To all the people who say stuff like "pedophiles/paedophiles will get their kicks from this, but IT'D BE DIFFERENT if it was a photo of a kid in a bathtub": that's silly and ignorant. You seriously think that someone who gets off on pics of naked kids isn't going to get off on the pic just because the kid is in a bathtub, just because it's a supposedly "traditional" family photo? Someone who likes seeing kids naked, LIKES SEEING KIDS NAKED, it doesn't matter why or how they're naked or what they're doing whilst naked.
So should we ban all pics of kids in bathtubs in their family homes? I think not. It's stupid to ban something just because there are some strange people out there. You might as well ban shoes (due to shoe fetish), socks (due to sock fetish), and eveything else that might turn certain individuals on.
You need to deal with the people who get turned on by kids, NOT the kids or the photos of the naked kids.

Oh yes, and don't forget to ban school uniforms too. Wouldn't want any Japanese men with a lolita fetish to see pics of your kids and get turned on.
So no more school sports day photos or photos of your child winning any school award
